A. Welcome to the Billionaire Row Gallery (the “Gallery”) website, operated and owned by NFT Art LLC. The following are the terms and conditions that govern your use of our website (the “Terms”). By accessing or using this website and NFT Art LLC's content, you agree to be bound by these Terms. If you do not accept any of these Terms, please stop accessing or using this website immediately. 

B. You must not reproduce, copy or sell any portion of Billionaire Row Gallery or Billionaire Row Gallery’s images and other contents owned by NFT art LLC or systematically download the Content and data of Billionaire Row Gallery to make or populate another database or for any other purpose.

C. You must not interfere or attempt to interfere with Billionaire Row Gallery’s Website in any manner. For example, you may not use any software program, virus or routine to block, obscure, overwrite or modify any Content or web pages or to destroy the software, hardware or telecommunications equipment of Billionaire Row Gallery’s Website or another person.

D. You must not use the information the Billionaire Row Gallery’s Website or images (including any downloaded raw data) in whole, in part and/or in combination with any other website or company, for any discriminatory, breach of privacy or otherwise illegal activity (for example, to sell art on another platform).

E. You must not post or publish any information that you know is false, inaccurate, or misleading, such as impersonating any person or entity, falsely misrepresenting your affiliation with any person or entity, falsely claiming an endorsement that you do not have, or misrepresenting that you are an employee or representative of Billionaire Row Gallery or otherwise affiliated with Billionaire Row Gallery.

F. You must not knowingly or willfully submit defamatory or offensive Content to the Website.

COPYRIGHT

All artwork is copyrighted by the artist. You are welcome to take pictures of the artwork, but do not reproduce, edit, or change any of the artworks without the artist Cagla Tokgoz's permission.

Copyright provides the owner of copyright with the exclusive right to 

• Reproduce the work in copies

• Prepare derivative works based upon the work

• Distribute copies of the work to the public by sale or other transfer of ownership or by rental, lease, or lending 

• Perform the work publicly if it is a literary, musical, dramatic, or choreographic work; a pantomime; or a motion picture or other audiovisual work 

• Display the work publicly if it is a literary, musical, dramatic, or choreographic work; a pantomime; or a pictorial, graphic, or sculptural work. This right also applies to the individual images of a motion picture or other audiovisual work.

USING THE SERVICES

As a condition of your use of the Services, you warrant to Billionaire Row Gallery that you will not use the Services for any purpose that is unlawful or prohibited by these Terms, conditions, or notices. You may not use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party’s use and enjoyment of the Services.

• (1) upload, post, email, or otherwise transmit any material that is derogatory, defamatory, obscene, or offensive, such as slurs, epithets, or anything that might reasonably be construed as harassment or disparagement based on race, color, national origin, sex, sexual orientation, age, disability, religious or political beliefs, or other statutorily protected status;
• (2) impersonate any person or entity, including, but not limited to, anyone affiliated with Billionaire Row Gallery, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• (3) add your own headers, forge headers, or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service;
• (5) upload, post, email, or otherwise claim to own any content that you do not have a right to under any law or under contractual or fiduciary relationships, inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
• (8) upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights (“Rights”) of Billionaire Row Gallery or any other party;
• (12) upload, post, email, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
• use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” any web pages or other services contained in the site, unless explicitly permitted by Billionaire Row Gallery;
• (14) do not engage in editing metadata to represent false ownership of any Billionaire Row Gallery art or website content;
• (15) All images reposted should give proper credit to the artist Cagla Tokgoz and Billionaire Row Gallery;
• (16) engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of Billionaire Row Gallery’s website;
• (16) attempt to or actually override any security component of Billionaire Row Gallery web services;
• (17) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service;
• (18) violate these Terms, any code of conduct or other guidelines which may be applicable for any particular area of the Service or have been communicated to you by anyone affiliated with Billionaire Row Gallery; or
• (19) intentionally or unintentionally violate any applicable local, state, national, or international law, or any regulations having the force of law.

EXHIBITIONS AND EVENTS

You understand and agree each private event hosted by our gallery is unique and tailored to the theme and location of the event. Our events are held at non-permanent locations, meaning the setting may vary depending on factors such as the best venue to express our artistic vision and theme, number of attendees, the country of the event, or the availability of the host. We assure our customers that we strive to maintain a high standard of excellence by carefully selecting prestigious hosts and curating unforgettable experiences that will be cherished. The images presented on our website of the exhibition spaces have the purpose of giving our customers a representation of dedication to theme.

Violations of the Terms

You agree that Billionaire Row Gallery may, in its sole discretion and without prior notice, terminate your access to the Services. You also agree that any violation by you of these Terms, including incorporated policies, such as the user conduct guidelines, will constitute an unlawful and unfair business practice, and will cause irreparable harm to Billionaire Row Gallery, for which monetary damages would be inadequate, and you consent to Billionaire Row Gallery obtaining any injunctive or equitable relief that Billionaire Row Gallery deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Billionaire Row Gallery may have at law or in equity. 

If Billionaire Row Gallery does take any legal action against you as a result of your violation of these Terms, Billionaire Row Gallery will be entitled to recover from you, and you agree to pay all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Billionaire Row Gallery. You agree that Billionaire Row Gallery and NFT Art LLC will not be liable to you or to any third party for termination of your access to the services as a result of any violation or suspected violation of these terms.
